Sabai Thai Spa Affiliate Agreement

This Affiliate Agreement ("Agreement") is entered into by and between Sabai Thai Spa ("Company"), headquartered in British Columbia, Canada, and the undersigned individual ("Affiliate" or "you"), effective as of the date of acceptance into the Sabai Thai Spa Affiliate Program (the "Program").

As an Affiliate, you agree to promote Sabai Thai Spa by sharing your unique affiliate links across your social media channels, websites, blogs, newsletters, and other digital platforms. You will encourage customers to purchase spa vouchers at sabaithai.com, and in return, you may earn commissions on eligible transactions.

You agree to:

• Represent the Sabai Thai Spa brand in a professional and positive manner.

• Only use approved links, banners, and promotional materials provided via the affiliate dashboard.

• Ensure your promotion of the Program complies with applicable laws, including advertising and consumer protection regulations.

You will remain an independent contractor and not an employee, agent, or representative of Sabai Thai Spa.

You agree not to:

• Make misleading or false claims about Sabai Thai Spa or its services.

• Use paid ads to compete with Sabai Thai Spa brand keywords (e.g., "Sabai Thai Spa," "Sabai Thai vouchers").

• Promote the Program on inappropriate websites, including those with pornographic or offensive content.

• Engage in fraudulent activity, such as self-referrals or manipulating cookie tracking.

You will receive commission on eligible purchases made through your unique affiliate link or promo code.

• Commission is paid monthly via bank transfer.

• To qualify for commission, referred sales must be for vouchers valued at a minimum of $100 each. A minimum threshold of $500 in total eligible sales is required before any payout can be issued. 

• Commission is only valid on completed, non-refunded orders.

• Commission is calculated based on the final purchase price (excluding taxes, shipping, discounts, and gift card usage).

• Sabai Thai Spa reserves the right to adjust or withhold commission in the case of suspected fraud or refund activity.

You are responsible for any taxes or fees related to your earnings under this Agreement.

Sabai Thai Spa may provide you with marketing materials to support your efforts. Any content you create (including posts, videos, or testimonials) that features or promotes Sabai Thai Spa may be shared by the Company across its own marketing channels (e.g., social media, email, or website) with appropriate credit given.

You grant Sabai Thai Spa a royalty-free, non-exclusive license to share and repurpose affiliate-created content for marketing purposes.

You agree to keep confidential any non-public information shared by Sabai Thai Spa, including affiliate program terms, performance data, or internal strategies.

Either party may terminate this Agreement at any time with written notice. Upon termination:

• You must stop using all affiliate materials and links.

• Any commissions earned prior to termination will be paid per the standard payout schedule.

Sabai Thai Spa reserves the right to remove any affiliate from the Program at its discretion.

You agree to:

• Comply with all Canadian advertising laws and regulations.

• Clearly disclose your affiliate relationship when promoting links, in accordance with Canadian guidelines (e.g., "#ad," "#sponsored," or "affiliate link").

Sabai Thai Spa is not liable for indirect, incidental, or consequential damages arising from this Program. The Company’s total liability under this Agreement is limited to the total commission earned by the Affiliate in the preceding three (3) months.

This Agreement shall be governed by and interpreted in accordance with the laws of the Province of British Columbia.

Sabai Thai Spa Affiliate Program – Privacy Policy

Sabai Thai Spa (“we,” “our,” or “us”) respects your privacy and is committed to protecting your personal data. This Privacy Policy describes how we collect, use, and share information when you join and participate in our Affiliate Program hosted on Refersion (“Program”).

By participating in the Program, you consent to the practices outlined in this Privacy Policy.

When you sign up for the Sabai Thai Spa Affiliate Program, we may collect the following types of information:

• Personal Information: Full name, email address, mailing address, payment details, and other information necessary to administer commissions and communicate with you.

• Account Information: Affiliate ID, login credentials (if applicable), referral link activity, sales conversions, and performance metrics.

• Marketing Preferences: Information you provide regarding how you prefer to receive communications from us.

• Device & Usage Information (automatically collected): IP address, browser type, device identifiers, and browsing behavior related to your affiliate dashboard and Refersion tracking cookies.

We use the information we collect to:

• Manage and operate the affiliate program

• Track sales and calculate commissions

• Send payments and tax documentation

• Communicate with you about updates, opportunities, and performance

• Improve our affiliate tools, platform experience, and analytics

• Meet legal, regulatory, and compliance requirements

We do not sell your personal information. We may share your data with trusted third parties, including:

• Refersion: Our affiliate management platform provider

• Processors: For conversion tracking (e.g WooCommerce)

• Service Providers: Who support our marketing, analytics, or technical operations under strict confidentiality agreements

• Legal Authorities: If required by law, subpoena, or to protect our legal rights

To track referrals and sales, Refersion uses cookies and similar tracking technologies. These cookies:

• Help attribute affiliate sales accurately

• Track performance and link activity

• Typically expire within 30 days

• By joining the program, you consent to the use of cookies in accordance with this policy and Refersion’s terms.

We retain your personal information for as long as you remain an active affiliate and as required to:

• Comply with legal obligations (e.g., tax reporting)

• Resolve disputes

• Enforce agreements

If you leave the program, we may retain non-personally identifiable data for analytical purposes.

You may request to:

• Access or update your personal information

• Delete or deactivate your account

• Withdraw from the affiliate program

• Opt-out of promotional communications

We implement reasonable technical and organizational safeguards to protect your data. However, no system is 100% secure. You are responsible for keeping your login credentials safe and reporting any suspicious activity immediately.

If you are located outside of Canada, your information will be processed and stored in Canada, subject to local data protection laws. By using our affiliate program, you consent to this transfer and processing.
